These General Terms and Conditions govern access to and use of the digital platform TRIBALBI PLATFORM<\/strong>, as well as the relationship between the platform and the users who access it.<\/p>

Access to and use of the platform implies full acceptance of these terms.<\/p>

The platform allows users to:<\/p>

  • register agreements or authorizations<\/p><\/li>

  • document consents<\/p><\/li>

  • maintain a digital history of such agreements<\/p><\/li>

  • organize documentation related to projects<\/p><\/li><\/ul>

    TRIBALBI provides technological tools for the management and registration of such information.<\/strong><\/p>

    3. Platform Users<\/h4>

    TRIBALBI PLATFORM may be used by:<\/p>

    • professionals in the creative sector<\/p><\/li>

    • agencies<\/p><\/li>

    • brands<\/p><\/li>

    • models<\/p><\/li>

    • other users involved in creative or advertising projects<\/p><\/li><\/ul>

      Users must provide truthful information when creating their accounts.<\/p>

      Each user is responsible for the use of their account and for maintaining the confidentiality of their access credentials.<\/p>

      4. Platform Operation<\/h4>

      TRIBALBI PLATFORM enables users to:<\/p>

      • create agreements or documents<\/p><\/li>

      • invite other parties to participate in such agreements<\/p><\/li>

      • register consents or acceptances<\/p><\/li>

      • maintain a record of actions related to those agreements<\/p><\/li><\/ul>

        The platform may record technical information associated with such actions in order to ensure system traceability<\/strong>.<\/p>

        5. Nature of the Service<\/h4>

        TRIBALBI PLATFORM acts exclusively as a provider of technological infrastructure<\/strong>.<\/p>

        Consequently:<\/p>

        • TRIBALBI is not a party to the agreements or contracts entered into between users<\/strong>.<\/p><\/li>

        • TRIBALBI does not validate or review the content of such agreements<\/strong>.<\/p><\/li>

        • TRIBALBI does not act as a contractual intermediary between the parties<\/strong>.<\/p><\/li><\/ul>

          Legal relationships arising from agreements registered on the platform correspond exclusively to the users who participate in them.<\/p>

          6. User Responsibilities<\/h4>

          Users are responsible for:<\/p>

          • the accuracy of the information provided<\/p><\/li>

          • the content of the agreements or documents they manage<\/p><\/li>

          • compliance with applicable legislation<\/p><\/li><\/ul>

            Users agree to use the platform lawfully and not to upload or introduce illegal, fraudulent, or rights-infringing content.<\/p>

            7. Limitation of Liability<\/h4>

            • the legality, validity, or execution of agreements between users<\/p><\/li>

            • the content of documents generated on the platform<\/p><\/li>

            • damages resulting from improper use of the system by users<\/p><\/li><\/ul>

              The platform is limited to providing technological tools for the management and registration of agreements<\/strong>.<\/p>

              8. Intellectual Property<\/h4>

              All elements that make up TRIBALBI PLATFORM, including:<\/p>

              • software<\/p><\/li>

              • design<\/p><\/li>

              • trademark<\/p><\/li>

              • logos<\/p><\/li>

              • platform structure<\/p><\/li><\/ul>

                are protected by intellectual and industrial property rights.<\/p>

                Their reproduction or use without the express authorization of the owner is prohibited.<\/p>

                Users retain rights over the content or documents they generate within the platform.<\/p>

                9. Suspension or Termination of Accounts<\/h4>

                TRIBALBI may suspend or terminate user access when:<\/p>

                • improper use of the platform is detected<\/p><\/li>

                • these terms are breached<\/p><\/li>

                • the system is used for unlawful activities<\/p><\/li><\/ul>

                  10. Service Availability<\/h4>

                  TRIBALBI PLATFORM strives to ensure the proper functioning of the service.<\/p>

                  However, the platform does not guarantee permanent system availability and may implement temporary interruptions due to technical reasons, maintenance, or service improvements.<\/p>

                  11. Data Protection<\/h4>

                  The processing of users’ personal data is governed by the TRIBALBI PLATFORM Privacy Policy.<\/strong><\/p>

                  12. Modifications to the Terms<\/h4>

                  TRIBALBI may modify these General Terms when necessary to adapt them to legal or technical changes.<\/p>

                  Any modifications will be published on the platform.<\/p>

                  13. Applicable Law and Jurisdiction<\/h4>

                  These General Terms are governed by the laws applicable within the European Economic Area<\/strong>, and, where appropriate, by Spanish law.<\/p>

                  For the resolution of any dispute arising from the use of the platform, the parties shall submit to the courts and tribunals of the registered address of the platform owner,<\/strong> unless applicable law provides otherwise.<\/p>

                  Image Rights and Project Content Clause<\/h4>

                  In this regard, users acknowledge and agree that:<\/p>

                  • Image rights, copyrights, or any other rights related to the content<\/strong> belong exclusively to the parties participating in each agreement.<\/p><\/li>

                  • TRIBALBI PLATFORM does not manage, acquire, or exploit <\/strong>such rights.<\/p><\/li>

                  • TRIBALBI PLATFORM does not act as an agency, representative, producer, or intermediary in the negotiation of such rights<\/strong>.<\/p><\/li><\/ul>

                    The platform is limited to providing technological tools that allow users to register and document the agreements reached between them<\/strong>.<\/p>

                    Responsibility for Authorizations<\/h6>

                    Users who register agreements related to image or content usage guarantee that:<\/p>

                    • they have the necessary authorizations<\/p><\/li>

                    • they have the legal capacity to grant such consents<\/p><\/li>

                    • the use of the content complies with applicable legislation<\/p><\/li><\/ul>

                      TRIBALBI PLATFORM does not verify the legal validity of such authorizations,<\/strong> which remain the sole responsibility of the users.<\/p>

                      Use of Content Within the Platform<\/h6>

                      The content, documents or materials uploaded to the platform remain the property of the users or their rightful owners<\/strong>.<\/p>

                      By using TRIBALBI PLATFORM, users grant only a limited technical license <\/strong>allowing the platform to:<\/p>

                      • store the documents<\/p><\/li>

                      • process the information<\/p><\/li>

                      • display it to the parties involved in the agreement<\/p><\/li><\/ul>

                        This license is limited exclusively to the technical operation of the service<\/strong>.<\/p>

                        Platform Neutrality Clause<\/h4>

                        TRIBALBI PLATFORM acts exclusively as a technological infrastructure provider designed to facilitate the registration, organization and traceability of agreements and consents between users<\/strong>.<\/p>

                        In this regard, users acknowledge and agree that:<\/p>

                        • TRIBALBI PLATFORM is not a party to agreements or contracts entered into between users<\/strong>.<\/p><\/li>

                        • TRIBALBI PLATFORM does not participate in the negotiation, drafting or legal validation of such agreements<\/strong>.<\/p><\/li>

                        • TRIBALBI PLATFORM does not represent any of the parties involved in the agreements registered on the platform<\/strong>.<\/p><\/li><\/ul>

                          The platform only provides technological tools that allow users to document and register actions carried out within the system<\/strong>.<\/p>

                          Independence of User Relationships<\/h6>

                          Legal relationships that may arise between users of the platform are independent from TRIBALBI PLATFORM<\/strong>.<\/p>

                          Each user acts under their own responsibility and is responsible for:<\/p>

                          • the content of agreements they enter into<\/p><\/li>

                          • compliance with obligations arising from those agreements<\/p><\/li>

                          • the legality of the authorizations granted<\/p><\/li><\/ul>

                            TRIBALBI PLATFORM assumes no responsibility for the content, validity, or execution of agreements between users<\/strong>.<\/p>

                            Technological Record Function<\/h6>

                            Records generated within TRIBALBI PLATFORM reflect actions performed by users within the system<\/strong>, such as the acceptance of agreements or the registration of consents.<\/p>

                            These records aim to document activity carried out on the platform<\/strong> and do not imply that TRIBALBI participates as a contractual party in agreements between users.<\/p>

                            Consent Matrix System<\/h4>

                            TRIBALBI PLATFORM may use structured consent configuration systems (referred to on the platform as Consent Matrix<\/em>) that allow users to define in a structured way certain conditions related to the use of content or image rights.<\/p>
